1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your access to and use of the BBGI platform operated by Black Business Growth Initiative (BBGI) (“we”, “us”, “our”).

 

By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the platform immediately.

 

2. LEGAL COMPLIANCE

These Terms are governed by the laws of the Republic of South Africa, including the Protection of Personal Information Act (POPIA) and applicable electronic communications legislation.

 

3. PLATFORM SERVICES

BBGI provides a digital ecosystem that includes:

• Business directory and listings
• User account registration
• Event creation, promotion, and ticket sales facilitation
• Campaign creation, promotion, and donation-based funding
• Networking and business growth opportunities
• We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

4. USER ACCOUNTS

4.1 Registration

To access certain features, users must register an account and provide accurate, complete information.

Users agree to:

• Provide truthful and current information

• Maintain confidentiality of login credentials

• Notify BBGI immediately of unauthorized access

 

4.2 Account Responsibility

Users are fully responsible for all activities conducted under their account.

BBGI reserves the right to suspend or terminate accounts that violate these Terms.

 

5. BUSINESS LISTINGS

5.1 Listing Fee

BBGI charges a R1,000 per annum (ZAR) fee for business listings. This fee may be updated from time to time at BBGI’s discretion.

 

5.2 Listing Requirements

By submitting a business listing, you confirm that:

• All information provided is accurate and lawful

• You have authority to represent the business

• Content does not infringe third-party rights

 

5.3 BBGI Rights

BBGI reserves the right to:

• Approve, reject, or edit listings

• Remove misleading, false, or inappropriate content

• Suspend listings that violate platform rules

 

6. EVENTS

6.1 Event Creation

Users may create and publish events on the platform at no cost.

 

6.2 Ticket Sales

Where applicable, event organisers may charge for ticket sales. BBGI may facilitate or integrate third-party payment systems for ticket processing.

 

6.3 Organizer Responsibility

Event organisers are responsible for:

• Accuracy of event details

• Fulfilment of event obligations

• Compliance with applicable laws and safety requirements

 

6.4 Changes and Cancellations

BBGI reserves the right to modify, suspend, or remove events that violate platform policies or legal requirements.

 

7. CAMPAIGNS

7.1 Campaign Creation

Users may create campaigns for fundraising, marketing, or awareness purposes.

 

7.2 Donations and Charges

Campaigns may accept donations or paid contributions via integrated payment systems.

 

7.3 Responsibility

Campaign creators are solely responsible for:

• Accuracy and legitimacy of campaign information

• Proper use of collected funds

• Compliance with applicable financial and legal obligations

 

8. USER CONDUCT

Users agree not to:

• Use the platform for unlawful purposes

• Upload false, misleading, or harmful content

• Attempt unauthorized access to systems

• Distribute malware, spam, or malicious content

• Infringe intellectual property rights

Violation may result in immediate suspension or legal action.

 

9. INTELLECTUAL PROPERTY

9.1 Ownership

All content on the BBGI platform, including branding, design, text, and software, remains the property of BBGI or its licensors.

 

9.2 License

Users are granted a limited, non-exclusive, non-transferable right to use the platform for its intended purposes.

Users may not:

• Copy or reproduce platform content without permission

• Use BBGI branding without written consent

 

10. PRIVACY AND POPIA COMPLIANCE

Use of the platform is subject to our Privacy Policy.

BBGI processes personal information in accordance with the Protection of Personal Information Act (POPIA) and ensures lawful, minimal, and secure data processing.

 

11. THIRD-PARTY SERVICES

BBGI may use third-party services such as:

• Payment gateways

• Analytics tools (e.g., Google Analytics)

• Hosting and infrastructure providers

BBGI is not responsible for third-party systems, content, or data practices.

 

12. ACCEPTABLE USE POLICY (AUP)

Users may not:

• Engage in illegal or fraudulent activities

• Upload harmful or malicious software

• Spam or abuse platform communication systems

• Harvest or scrape data without permission

• Publish hate speech, abusive, or defamatory content

BBGI reserves the right to enforce content moderation and account restrictions.

 

13. COMMUNITY GUIDELINES

All businesses and users must maintain professional standards:

• Provide accurate and transparent information

• Engage respectfully with users and customers

• Avoid fake reviews or misleading claims

• Comply with all applicable South African laws

BBGI may remove listings or accounts that fail to meet community standards.

 

14. INTELLECTUAL PROPERTY RIGHTS

All trademarks, branding, and platform content are protected under applicable intellectual property laws.

Unauthorized use is strictly prohibited.

 

15. DISCLAIMERS

15.1 Platform Availability

BBGI does not guarantee uninterrupted or error-free access to the platform.

 

15.2 Content Accuracy

BBGI does not guarantee the accuracy, reliability, or completeness of:

• Business listings

• Events

• Campaigns

Users interact with content at their own risk.

 

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BBGI shall not be liable for:

• Loss of income, data, or business opportunities

• Indirect or consequential damages

• Losses arising from platform use or inability to access services

 

17. INDEMNITY

Users agree to indemnify BBGI against any claims, damages, or liabilities arising from:

• Use of the platform

• Violation of these Terms

• Infringement of third-party rights

 

18. TERMINATION

BBGI may suspend or terminate user accounts or listings at any time if:

• These Terms are violated

• Fraudulent or illegal activity is detected

• Platform integrity is at risk

 

19. GOVERNING LAW

These Terms are governed by the laws of South Africa.

All disputes shall fall under the jurisdiction of South African courts.

 

20. DISPUTE RESOLUTION

Disputes should first be resolved amicably. If unresolved, matters may proceed through:
